Terms of service
This purchase is subject to the following standard terms and conditions for consumer purchases of goods over the internet. Consumer purchases online are primarily regulated by contract law, consumer purchase law, marketing law, right of withdrawal law, and e-commerce law, which grant consumers undeniable rights. The conditions in this agreement should not be seen as limiting statutory rights but rather outlining the main rights and obligations of the parties involved in the transaction.
1. The Agreement
The agreement consists of these terms and conditions, information provided during the ordering process, and any specifically agreed terms. In case of a conflict, what has been explicitly agreed between the parties will apply, provided it does not contradict mandatory legal provisions.
The agreement is also supplemented by relevant legal provisions regulating the purchase of goods between businesses and consumers.
2. The Parties
The seller is Grey Area AS, hi@theoryboat.app, referred to as the seller/we/us.
The buyer is the consumer making the purchase, referred to as the buyer/you.
3. Prices
The total price of the purchase will be shown before checkout and includes all costs associated with the purchase. GST is included if applicable.
4. Formation of the Agreement
The agreement is binding for both parties once the buyer submits the order to the seller.
However, the agreement is not binding if there has been a typo or other obvious error in the offer from the seller in the online store, or in the buyer’s order, and the other party realized or should have realized that an error occurred.
Once we receive your order, we will confirm it and automatically send you an order confirmation. Please review the confirmation carefully to ensure it matches your order.
5. Personal Data
The person responsible for processing personal data is the seller. Unless the buyer consents otherwise, the seller may only collect and store personal data necessary to fulfill the obligations under the agreement. The buyer’s personal information will only be shared with others if necessary to fulfill the agreement or in legally required situations.
6. Dispute Resolution
Complaints should be directed to the seller within a reasonable time, as outlined in sections 9 and 10. The parties should attempt to resolve any disputes amicably. If this fails, you can bring the case to a consumer council near your location. All disputes must be resolved in accordance with Norwegian law. If the matter is taken to court, it will be settled in your jurisdiction, typically near where you live.
7. Purchase and Use of Digital Products
When you purchase a subscription at theoryboat.ap, you will receive immediate access to TheoryBoat sent to your email. To activate your account, you MUST have and link your Apple or Google account.
The subscription period begins when you activate your access.
The service is available 24 hours a day, though downtime may occur due to technical maintenance or error corrections.
The access you purchase is personal and can only be used by one person.
When subscribing to TheoryBoat, you agree to receive the service, acknowledging that your right of withdrawal ceases once the service is delivered/activated.
For the “TheoryBoat+ Forever” product, the option to request a refund for defects or faults applies for one year from the purchase date.
TheoryBoat (the app) works only on iOS and Android devices.
8. Disclaimer
The online store reserves the right to price changes, and any errors in text, images, and links on our website.
9. Other
For the “TheoryBoat+ Forever” product, we guarantee the service will be available for at least one year from the date of purchase. If the service is discontinued after this period, you will lose access. Note that as long as the “TheoryBoat+ Forever” service is active, your access remains.
10. Payment Options
Our online store uses Shopify Payments as the payment processor. Shopify Payments is a secure and reliable payment solution that uses security standards such as 3D-Secure, SSL, Verified by Visa, and MasterCard Secure Code. Payment pages are encrypted and secured to ensure that no one can access your card information.
Accepted payment methods in the online store are Visa, MasterCard, American Express, Google Pay & Apple Pay.
TheoryBoat can be downloaded via Apple App Store and Google Play. In-app payments can be made directly through App Store and Google Play.
